Baltcott's General terms of lease 2008

1. General
1.1. The tenant signs a binding contract with the Estonian company Baltcott OÜ (hereinafter called "BC"). BC sends a written confirmation on each booking. The booking can be done in writing, verbally over the phones or via Internet. The written confirmation of booking also contains a "Proof of lease" with all relevant information (address etc…). At arrival this proof of lease is to be given to the cottage owner or his/her representative. The tenant then receives the key and a document that needs to be filled out (electricity and other expenses are not included in booking price). The electricity meter is to controlled together with the owner (or representative) and the number is written down both at arrival and departure. In every group leasing the cottage, at least one individual must be 25 years of age. Under no circumstances are underage children allowed to rent the cottage on their own.

2. The services of Baltcott
2.1. Descriptions and prices in the catalogue and in other places are valid until they are changed. The price at the time of booking however is always valid.
2.2. BC will not take any responsibility over given information concerning other arrangements except those concerning the cottages. BC also does not take any responsibility over any services or lack of services that the tenant booked or claimed without cooperating with BC.
2.3. What the BC service includes is given by the BC Internet site and the correspondence between BC and the tenant. All changes or amendments are valid with the proof of lease if they have been notified to the tenant in writing. Any side agreement that influences the scope of BC's services must be expressly confirmed by BC. The tenant is obliged to print out the description of the cottage from the BC Internet site in connection with the booking.
2.4. Travel agents or booking places do not have the right to admit any extra privileges or agree about such privileges that are not included in this agreement or the catalogue.

3. Terms of payment
3.1. The price for a cottage is given a the price per week (Saturday - Saturday). When longer leases are requested then the price will vary compared to season.
3.2. All prices are in EURO. The exchange rate at the time of payment is valid. All banking transfer fees in connection with payment are to be paid by the tenant.
3.3. 30% of the rent must be prepaid when the written confirmation arrives. The total price, minus prepayment, must be paid to BC no later than 4 weeks ahead of arrival date. If a lease is concluded less than 40 days before arrival, the full amount must be paid immediately after receiving the written confirmation. Without full payment the tenant has not rights or claims towards either BC or the owner of the cottage.

4. Changed circumstances
4.1. BC is obliged to immediately inform the tenant of changed circumstances. If the changed circumstances are severe then the tenant has the right to terminate the agreement. Severe changes means changes that changes the total impression of the cottage.
4.2. BC has the right to rise the price if more than 3 months has passed between booking and arrival. BC in not entitled to claim a rise in the price if less than 20 days remain until arrival. Any such rise in the price can only be in regards to changed circumstances between booking and the 20th day before arrival, and then BC can only claim any rise in costs. On reason could be, for example, changed exchange rate or new taxes or fees.
4.3. BC informs the tenant about the reason for rising costs immediately as the circumstance becomes known to BC. If the price rises more than 10% then the tenant has the right to terminate the agreement, or as with cancellation made by BC, claim that BC offers a cottage of equivalent standard- without any extra costs for the tenant - out of the BC register . The tenant must immediately state any claims in written form or via fax to BC in regards to this right.

5. Rules of conduct during stay.
5.1. Apart from maximum allowed persons only one child up to 3 years of age is allowed. If there are more than allowed guests then both BC and the owner has the right to refuse any extra guests (extra guests are all persons above the maximum allowed). The tenant does not have any right to any claims in regards to this. The cottages can never be accessed before 16.00 o'clock on arrival day.
The cottage must be cleared before 10 o'clock on day of departure. The tenant is responsible for cleaning the cottage. At departure the cottage and all its inventory must be left in good condition. A possible final cleaning can be ordered, in some cases, to be done by the owner or the owners representative.
It is not allowed to place any trailers, mobile homes or tents on the premises (unless otherwise agreed upon).
5.2. The "proof of lease" gives the owners name and address as well as the address of the cottage.
5.3. BC has been given the right, by the owner to act independently, on behalf of the owner. The cottage is not owned by BC. The cottage is only supplied by BC:
5.4. Electricity, heat, gas, water and phone are extra costs and are calculated when the key is returned on departure. During exceptionally cold seasons, and for cottages with swimming pools and/or jacuzzis and/or saunas the tenant should calculate with higher heating costs.
5.5. As security for the tenants obligations to return the key, note the electrical meter, pay the electricity and/or possible claims in regards to damages or penalties for departure without cleaning, the tenant must on some occasions pay a deposit to the owner or the owners representative (normally the deposit is around EEK 1500 or half a weeks rent). This deposit is paid at the time of receiving the key. At departure the tenant must return the key and the information about meters (electricity etc) to the owner or the owners representative. The owner or the representative must control the numbers given by the tenant before the next guest arrives. The deposition amount are then returned the tenant. Possible damages, or bad cleaning, is deducted from the deposition amount. Possible claims that are larger than the deposition amount will be calculated separately.
5.6. The tenant is responsible for damages tothe cottage or the inventory. If the damage is so great that the owner must use the owners insurance then the tenant will be responsible to pay all "own risk" amounts to the insurance company. If any damage is done that is done through gross negligence and is not covered by the owners insurance, then the tenant can be claimed for a higher amount. If the insurance is not valid for any other reason then the claim on the tenant is reduced to hypothetical "own risk".
5.7. Any pets are only allowed in those cottages that it is expressly allowed in the description of the cottage unless special approval has been given and noted on the proof of lease confirmation sent by BC. All possible special circumstances in regards to bringing dogs, cats or other pets to Estonia the tenant is recommended to contact the Estonian consulate. It is up the each tenant to apply for possible special approvals themselves. This also applies to hunters wanting to bring their own weapons.

6. Cancelling
The tenant can up until the arrival date cancel or change booking by sending a written message about this to BC. If the tenant cancels or does not start the stay, BC has the right to claim the tenant for costs in regards to preparations done by BC and other costs in relation to this by BC.
Standard amounts for BC costs in regards to cancelling:
6.1. Up until day 90 before arrival date 15% of the price, minimum EUR 50.-.
6.2. Between day 89 and day 45 before arrival 25% of the price, minimum EUR 50.-.
6.3. Between day 44 and day 15 before arrival 80% of the price.
6.4. Starting 14 days before arrival and with failure to arrive, 100% of the price.

7. Rebooking
On behalf of the wishes of the tenant BC - as much as possible - conducts rebooking up until day 90 before arrival date. For this BC charges a standard fee of EUR 50 for rebooking. Any changes or rebooking can only be done after the termination of the agreement in accordance with terms stated above.

8. Termination of contract by BC
The following circumstances gives BC the right to terminate the contract before arrival date.
8.1. If BC is not able to provide the cottage due to unexpected reasons that makes it impossible for the owner to fulfil the owners obligations. The right to terminate is only given to BC, and under such circumstances BC can, if possible, offer an equivalent cottage. If the tenant does not accept a possible new cottage then BC can terminate the contract. The tenant is during these circumstances entitled to refund of all prepaid sums.
8.2. If the tenant does not fulfil his/her obligations in regards to payment, then BC will send a reminder stating a last day of payment and a notice of termination of contract. Unless the tenant does not pay within this timeframe then BC can terminate the contract. Under such termination the fees mentioned under point 6 above are valid.
8.3. Whenever the tenant or any guests of the tenant, in spite of notice from the owner, the owners representative or BC, does not behave accordingly or misuses the cottage or behaves in a way that is not in accordance with the contract terms, an immediate termination is justified. During these circumstances BC has the right to withhold the full rent. Possible extra costs for transportation back home is to be paid by the tenant.

9. Force majeure
If a circumstance at the time of conclusion of the agreement is made difficult, or severely lowers the standard due to Force Majeure, then BC or the tenant can terminate the contract. Force majeure include among other things: War, Strike, lockout, closing of borders, epidemics or nature and pollution disasters. If the contract is terminated due to Force Majeure the BC can claim a reasonable fee for expenses made or extra costs in regards to termination of visit..

10. Responsibilities etc.
10.1. BC is responsible within normal business conduct and responsibility for all given information in the catalogue or on the web site in regards to that the description of the cottage is correct. BC does not take responsibility for any information in other catalogues that is not under BCs direct influence and BC is in no position to control the correctness of this given information. BC is responsible for careful examination of any cottage and the owners.
10.2. BC does not take responsibility for shortcomings in services in regards to services ordered by the tenant without using BC as go-between (museum visits, sports arrangements etc...).
10.3. Participation in sports events or other activities is the responsibility of the tenant. It is up to the tenant to check the sport facilities, tools and vehicles before usage.

11. Non usage of services
If the tenant, due to reasons not covered by the BC responsibility, the cottage is not used, then the tenant is not given the right to compensation.

12. Sickness
Any extra costs that occur due to sickness during the stay is to be paid by the tenant. Also extra costs for returning home is also to be paid by the tenant. In there is uncertainty about the nature of the sickness then BC strongly recommends that a doctor is contacted before termination of the stay.

14. Applications and claims
14.1. In case there are any occurrence of trouble then the tenant is requested to turn to the owner primarily or the owners representative.
14.2. The tenant is obliged to state any shortcomings or claims to BC. Furthermore the tenant must give BC reasonable time to repair the shortcoming before a termination of contract occurs, unless the fault is not possible to repair, of if BC refuses to repair.
14.3 Any claims on BC, must be done by the tenant within one month after date of departure, in writing to the following address: Baltcott OÜ, Raua Põik 3-3, 10124 Tallinn, Estonia. The tenants claims are null and void after 6 months. This time is calculated with start on date of departure according to the contract.

15. Special isolated incorrectness.
If one isolated incorrectness occur then this does not mean that the whole agreement is null and void.

16. Transfer of rights.
Regardless of the reason, the tenant has the right to transfer his rights in relation to the booking to a third party. BC must however be informed and BC must give approval.

17. Miscellaneous
17.1. BC is not responsible for bad photos or error in prints. BC reserves the right to faults in descriptions and pictures.
17.2. All professional usage of original or copy of the BC catalogue, and all usage of BC material in digital or other form is prohibited and falls under the laws of intellectual property rights.

18. Conflicts
Any possible conflict that derives from this agreement or the interpretation of this agreement falls under the jurisdiction of Estonian law and any dispute falls under the jurisdiction of the Estonian court system (Civil courts of Tallinn).
